These Terms of Service ("Terms") are a binding agreement between you and Digital Broker Marketing ("Digital Broker Marketing," "we," "us," or "our") governing your access to and use of the website at digitalbmarketing.com, including all pages, content, forms, and tools on it (together, the "Site").
By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site. If you are using the Site on behalf of a business, you represent that you have authority to bind that business, and "you" includes the business.
Digital Broker Marketing is a digital marketing and business growth infrastructure company based in Laguna Niguel, California, serving established businesses across Southern California. In these Terms:
The Site describes our Services, shares case studies and educational content, and lets you request an Audit or contact us. The Site is informational. Nothing on it constitutes legal, financial, accounting, or other professional advice, and nothing on it creates a client relationship by itself.
The Site is intended for use by businesses and by individuals who are at least 18 years old. By using the Site, you confirm you meet these requirements.
The Audit is a genuine, no-cost review of a business's digital growth system — typically covering the website, Google presence, advertising, SEO, AI search visibility, tracking, CRM, reporting, and follow-up process. About the Audit:
If your business engages us for Services, that engagement will be governed by a separate written agreement covering scope, deliverables, fees, timelines, confidentiality, and termination. That written agreement — not these Terms — controls the engagement. In the event of any conflict between these Terms and a signed service agreement, the service agreement wins for matters within its scope.

We do not guarantee — and you should not interpret anything on the Site as guaranteeing — specific search rankings, placement or citation in AI platforms (such as ChatGPT, Perplexity, Gemini, or Google AI Overviews), lead volume, appointment volume, conversion rates, or revenue. Search engines and AI platforms control their own results. What we stand behind is the quality of the work: honest audits, properly built infrastructure, and measurement that shows you what your investment is actually producing.

TO THE FULLEST EXTENT PERMITTED BY LAW, DIGITAL BROKER MARKETING AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE'VE BEEN ADVISED SUCH DAMAGES ARE POSSIBLE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This limitation applies to the free, informational Site. Liability arising from a paid service engagement is addressed in the applicable written service agreement. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or willful misconduct.
You agree to defend, indemnify, and hold harmless Digital Broker Marketing from and against claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right in connection with the Site.
These Terms and any dispute arising from them or the Site are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California, and waive any objection to that venue.
Before filing any formal claim, you agree to contact us at hello@digitalbmarketing.com with a description of the issue and give us 30 days to work toward an informal resolution. Most problems are misunderstandings, and we fix those fast. This informal step doesn't waive either party's rights if resolution fails.
We may update these Terms from time to time. Updated Terms take effect when posted on this page with a revised "Last updated" date. For material changes, we'll make the update reasonably visible. Continuing to use the Site after changes take effect constitutes acceptance.
